I. Terms and Conditions
1. Basic Provisions
- The following Terms and Conditions apply to contracts concluded between you and us as the provider (Mamadou Aliou Diallo) through our website.
Unless otherwise agreed, the inclusion of any of your own terms and conditions is hereby excluded.
- For the purposes of these Terms and Conditions:
- A consumer means any natural person entering into a legal transaction for purposes that are wholly or mainly outside their trade, business, craft or profession.
- A business customer means any natural or legal person, or a partnership with legal capacity, acting in the exercise of their trade, business or profession when entering into the contract.
2. Formation of the Contract
- The subject of the contract is the sale of goods.
- By listing a product on our website, we make you a binding offer to conclude a purchase contract via our online shopping basket system under the conditions specified in the relevant product description.
- The contract is concluded through the online shopping basket system as follows:
• The goods you intend to purchase are placed in the shopping basket.
• You can access the shopping basket at any time using the relevant button in the navigation bar and make changes before placing your order.
• After clicking "Checkout", "Continue to Checkout" or a similar button, and entering your personal details together with your chosen payment and delivery options, you will be shown an order summary.
• If you choose an instant payment method such as PayPal (Express/Plus/Checkout), Amazon Pay or Sofort, you may either be redirected to the payment provider's website or first shown the order summary page within our online shop.
• Once the payment process has been completed, you will be returned to our online shop (where applicable) and presented with the final order summary.
• Before submitting your order, you have the opportunity to review all information, amend it (including by using your browser's back button), or cancel the order.
• By clicking the button labelled "Place Order", "Buy Now", "Pay Now", "Complete Purchase" or another similarly worded button, you submit a legally binding acceptance of our offer. At this point, the contract is concluded.
- Order processing and the transmission of all information required in connection with the contract are carried out partly by automated email.
You are therefore responsible for ensuring that the email address you provide is correct, that emails can be received, and that they are not blocked by spam filters.

4. Right of Retention and Retention of Title

Where any characteristic of the goods differs from the objective requirements, such deviation shall only be deemed agreed if you were informed of it before placing your order and the deviation was expressly agreed between both parties.
6. Applicable Law

For consumers, this choice of law applies only to the extent that it does not deprive you of the protection provided by mandatory provisions of the law of the country in which you have your habitual residence.

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

We do not permanently store the complete contract text.
Before submitting your order through the online shopping basket system, you may print or electronically save your order details using your browser's print function.
After we receive your order, the order details, the legally required information for distance selling contracts, and these Terms and Conditions will be sent to you again by email.

6. Delivery

Transfer of Risk
Where you are purchasing as a consumer, the risk of accidental loss or accidental damage to the goods passes to you only when the goods have been delivered to you, regardless of whether the shipment is insured.
This does not apply where you have independently appointed a carrier or another person to transport the goods who was not nominated by us.
7. Statutory Rights for Defective Goods
Your statutory rights relating to defective goods are governed by the Statutory Warranty provisions set out in these Terms and Conditions (Part I).
